Terms and Conditions of Sale

These General Terms and Conditions of Sale govern the offer and sale of products on the website https://www.rosabakehouse.com (hereinafter “Site” or “rosabakehouse”).

Products purchased on the Site are sold by ROSABAKEHOUSE Cultural Association (hereinafter “RBH”), with registered office at Via Scoranello, 14 00060 CAPENA-Rome, Tax Code 97930000589, telephone 348 1382967, email info@rosabakehouse.com. The selling prices indicated are expressed in euros including VAT and do not include shipping costs. The latter, when applicable, are always borne by the Customer and are chargeable at the time of order validation. RBH reserves the right to update the prices indicated on the Site, without prejudice to consumer rights regarding the prices indicated at the time of order. The offer and sale of products on the Site comply with the provisions of Legislative Decree No. 206/2005 (so-called Consumer Code), and subsequent amendments, as well as those provided for by Legislative Decree April 9, 2003, No. 70.

Event Conditions

RELEASE FORM
Release form for the use of photographs and/or videos: purchasing the course automatically implies acceptance of the following conditions: the participant, with reference to photos and/or audio/video recordings taken by RosaBakehouse, AUTHORIZES free of charge, also pursuant to Articles 10 and 320 of the Civil Code and Articles 96 and 97 of Law No. 633 of April 22, 1941, Copyright Law, the use of photos or videos taken during initiatives and events organized by RosaBakehouse and authorizes the storage of said photos and audio/videos in the company’s computer archives. This release/authorization may be revoked at any time with written communication to be sent to the following email address: info@rosabakehouse.com
Videos and photos may be taken during the event only for personal use and may not be distributed.

CANCELLATION
Cancellation terms: to secure your place, a deposit is required (in some cases the full participation fee), but up to 7 days before the course, if you cancel your participation, you will receive a full refund of the fee paid. You would lose the amount paid if you cancel within the 7 days preceding or on the day of the course itself.

What happens to Your order a moment after purchasing on rosabakehouse:

A) Day 0 (order receipt)

The back office processes orders received by 3:00 PM; orders received after this time are processed the following day. Orders received on Saturday, Sunday, or a holiday will be processed on the first business day following the order date.
If the goods are available, the order is processed based on the chosen payment method, specifically:

  • if the chosen payment method is CREDIT CARD, PAYPAL, CASH ON DELIVERY, the order is processed immediately after production;
  • if the chosen payment method is BANK TRANSFER, the order is processed when the order amount inflow is visible in RBH’s accounts.
B) Day 1 (shipping courier)
the day after the order, the Shipping Courier picks up the goods at our warehouses by 6:00 PM, to which we have sent the D.D.T. (Transport Document) and/or R.A. (Purchase Receipt) and/or F.A. (Purchase Invoice) containing the destination location and any notes entered in the order (e.g., appointment for delivery).
C) Day 2 (tracking number assignment)
the day after pickup, the shipping courier assigns the shipment number (tracking number) and dispatches the goods. Our back office enters the tracking number in the customer’s private area, allowing them to track the delivery status and estimated times in real time on the shipping courier’s website.
D) Days 3-4 (goods delivery)
the product is delivered to the address indicated by the Customer at the time of order confirmation. Shipping costs are borne by the Customer and are calculated based on the volume and/or weight of the ordered item(s). However, product delivery times vary depending on the requested item, payment methods, and delivery methods chosen by the Customer, which is why the indicated times are merely indicative and cannot be considered binding for RBH. In any case, RBH will deliver the purchased products without undue delay and, at the latest, within 30 days from the purchase date.

  • Online orders are delivered throughout Italy, except for Livigno, Campione d’Italia.
  • During certain periods of the year (e.g., summer period, Christmas period, etc.), processing times may change compared to the standard times declared above.
    In this case, please refer to the times indicated in the individual product sheet.

Shipping Costs
As described above, shipping costs are calculated based on the volume and/or weight of the items ordered by the Customer. There are accessory (extra) services such as insured shipping and delivery by appointment (our “Cart” automatically recalculates the order total whenever you add or remove an extra option).

Product Information
Images and descriptions reproduce product characteristics as faithfully as possible. However, product colors may differ from real ones due to computer system settings or devices used by users for their display. Additionally, product images may differ in size or in relation to any accessory products. These images should therefore be considered indicative and with usage tolerances. For the purchase contract, the product description contained in the order form sent by the user shall prevail.

Tax Documentation
For every order placed as a “Private Customer”, Rosabakehouse will issue a “purchase receipt” (equivalent to a fiscal receipt and therefore valid as Product Warranty).
If you wish to receive an invoice instead (for tax reasons), you must specify this by checking the “I wish to receive an invoice” box on the “Order Confirmation” page (after order completion) and entering the tax code in the appropriate field.For every order placed as a “Company” or “Individual Business/Professional”, to receive the invoice, simply fill in the appropriate fields in the registration form.In any case, for the issuance of the tax document, the information provided by the Customer at the time of order shall prevail.
Invoices will not be issued for customers who have not expressed the aforementioned request during purchase, following the required procedures.The tax documentation is inserted at the time of shipment inside a transparent envelope attached to the outside of the package and is also downloadable through the “View my tax documents” section in your “Account” area.
The customer can, however, request a copy by filling out the appropriate online form.
The tax documentation (purchase receipt and/or invoice) must be carefully preserved, as it represents the valid document for the product warranty.

Order Processing

RBH, to ensure proper service to its Customers, guarantees the receipt and acceptance of purchase orders until 3:00 PM from Monday to Friday; orders received after this time, as well as those received on Saturday, Sunday, or other holidays, will be considered received on the first business day following the order date. Any reductions in working hours and/or interruptions of sales services during particular periods of the year (e.g., summer months) that could result in extended delivery times will be adequately highlighted at the time of order, and it will be at the Customer’s discretion to proceed or not with the confirmation according to the indicated timescales.

At the time of goods delivery, the Customer must check:

  • that the number of packages delivered corresponds to what is indicated in the transport document
  • that the packaging appears intact and unaltered, including the sealing tapes.

In case of tampering and/or breakage, the Customer must immediately contest the shipment and/or delivery by writing “RESERVATION FOR DAMAGED PACKAGING” on the copy of the delivery document to be returned signed to the courier or other operator who delivered the goods. In any case, subject to the terms for the legal warranty, the Customer must promptly communicate any tampering or breakage of the packaging through the appropriate online form.
For every delivery order, the Customer must specify at least one telephone contact to allow the express courier to contact them in case of delivery difficulties; if delivery fails for reasons not attributable to RBH or the express courier for more than 5 consecutive days, the order will be considered canceled and the Customer will be charged storage fees as quantified by the express courier.

Right of Withdrawal

In case already paid goods are refused upon delivery, the refusal will be considered as a withdrawal request, therefore upon return of the product, the outgoing and return shipping costs of the goods will be deducted.

As provided in Article 59 of the Consumer Code, the right of withdrawal does not apply:

  1. in the case of supply of custom-made or clearly personalized goods or goods that, by their nature, cannot be returned or risk deteriorating or expiring quickly;
  2. in the case of supply of sealed audiovisual products or computer software, opened by the consumer;
  3. in the case of supply of consumable products (e.g., cartridges, toner), if the packaging is not sealed;
  4. in the case of supply of sealed goods that are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery;
  5. to professionals and companies for whom an invoice has been issued, as they do not fall under private individuals;

Sales Contract
Following the completion of the purchase procedure, concurrently with the shipment of the goods, RBH proceeds to issue tax documentation, which will be attached to the product and will also be downloadable from the “Account” section. Upon request, it can be sent by email to the order holder as provided by ex Art. 14 DPR 445/00 and DL 52/2004 and any other related regulation.
RBH includes in the tax documentation only the data provided by the Customer at the time of order, specifying that no changes will be allowed after its issuance.The Customer can only purchase products, as per the electronic catalog on the rosabakehouse.com website, existing at the time of order submission. The Customer declares to be aware that the “available” wording of the displayed product is merely indicative. It may indeed happen that, with multiple purchases by multiple users, the selected product is not actually available. It follows that RBH reserves the right, once the order is received, to verify the actual availability of the possibly ordered goods and, if unavailable, promptly communicate the non-acceptance of the sent order for the aforementioned reasons.RBH confirms the correct receipt of the order by sending an email to the email address provided by the Customer, in which all data relating to the order placed will be indicated. The Customer undertakes to verify its correctness and to promptly communicate any corrections. After verifying the actual availability of the goods and the correctness of the customer data, RBH will send the definitive acceptance of the contract via email, which only from this moment must be considered concluded and stipulated between the parties with full legal effect.By placing an order on the rosabakehouse.com website, the Customer declares to have read the terms and conditions of sale and the proposed payment methods, as well as the entire purchase procedure and also declares to accept them without any reservation and to have received exhaustive information in this regard. It is recommended to keep the emails sent by rosabakehouse.com.

ODR
EU Regulation No. 524/2013 and Legislative Decree No. 130/2015 introduced legislation aimed at facilitating the out-of-court settlement of disputes between consumers and commercial operators relating to a product or service purchased online. For this purpose, a European Online Dispute Resolution platform (so-called ODR platform) has been created, available at http://ec.europa.eu/consumers/odr/. Through the ODR platform, the consumer can submit a complaint relating to a contract concluded online with our company and thus activate the online dispute resolution procedure.

Website Use and Liability

The Customer/user connects to and uses the services offered by the site at their own discretion and responsibility. RBH cannot in any case be held responsible for direct or indirect damages (financial, monetary, economic losses) possibly suffered by users or third parties as a result of connecting to the site, and/or the inability to access it, and/or its good or bad functioning. In particular, RBH is not responsible for the slowness or interruption of data transmission, loss, disappearance, or alteration of data, from viruses, whatever their origin, from intrusion by third parties and, in general, from the use of the site or the impossibility of using it.

RBH cannot be held responsible in case of partial or total loss of data from its computer systems; the Customer/user is always invited to keep their own backup of sent data. Processed images will be deleted from its systems within 15 days after the order. In case of loss or damage to media containing data, RBH will limit itself to replacing the media with a virgin product of equivalent quality. The Customer/user is solely responsible for communications and data uploads on the site carried out by them. The indication of links to other sites is made for the convenience of the Customer/user; RBH cannot in any case be held responsible for the content of said sites and for complaints or direct or indirect damages caused to a user or third parties by the content of such sites.

Applicable Law
The sales contract between the Customer and ROSABAKEHOUSE is deemed concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes that may arise from the conclusion of this distance sales contract, if the Customer is a consumer pursuant to the Consumer Code, the territorial jurisdiction is that of the court of their municipality of residence or domicile; in all other cases, the territorial jurisdiction is exclusively that of the Court of Rome.
